1. Acceptance of Terms

By installing, accessing, or using the FastCapture browser extension ("the Extension", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must uninstall the Extension and discontinue use.

These Terms constitute a legally binding agreement between you ("User", "you") and FastCapture ("we", "us", "our"). You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Extension.

2. Description of Service

FastCapture is a browser extension for Chrome and Edge that provides:

  • Screen recording (tab, desktop, or window capture with optional webcam overlay and audio)
  • Screenshot capture (visible area, full page, custom region, or all tabs)
  • Media export in multiple formats (WebM, MP4, GIF, PNG, JPG, PDF)
  • Optional sharing via Gmail integration

All processing is performed locally within your browser. No data is uploaded to our servers.

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Extension for personal and commercial purposes, subject to these Terms. This license does not include the right to modify, reverse-engineer, decompile, disassemble, or create derivative works based on the Extension.

You may not distribute, sublicense, lease, rent, or lend the Extension to third parties. You may not use the Extension to develop a competing product or service.

4. User Content and Ownership

You retain full ownership of all recordings, screenshots, and other media you create using the Extension ("User Content"). We do not claim any rights over your User Content. Since all processing occurs locally in your browser, we never have access to your User Content.

You are solely responsible for your User Content and for ensuring that it does not violate any applicable laws, regulations, or third-party rights (including copyright, trademark, privacy, and publicity rights).

You acknowledge that screen recordings and screenshots may capture copyrighted material, private communications, or sensitive information. It is your responsibility to obtain any necessary permissions or consents before recording or capturing content.

5. User Responsibilities

You agree to use the Extension in compliance with all applicable local, national, and international laws and regulations. You are solely responsible for determining whether your use of the Extension is lawful in your jurisdiction, including but not limited to laws regarding recording consent (one-party vs. two-party consent), data protection, intellectual property, and workplace privacy.

6. Prohibited Uses

You agree not to use the Extension to:

  • Record, capture, or distribute content without the consent of all parties where required by law
  • Capture or distribute copyrighted material in violation of applicable copyright laws
  • Record or capture content that is illegal, defamatory, obscene, harassing, threatening, or that promotes violence or discrimination
  • Interfere with or circumvent the security features of any website, application, or system
  • Use the Extension to conduct surveillance, stalking, or any form of unauthorized monitoring of individuals
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Extension
  • Remove, alter, or obscure any proprietary notices, labels, or branding in the Extension
  • Use the Extension in any manner that could damage, disable, overburden, or impair any website or interfere with any other party's use of the Extension

7. Intellectual Property

The Extension, including its source code, design, user interface, icons, and documentation, is the exclusive intellectual property of FastCapture and is protected by applicable copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

The FastCapture name, logo, and related trademarks are our property. You may not use our trademarks without prior written consent, except as necessary to refer to our product in a factual, non-misleading manner.

8. Third-Party Services and Links

The Extension may interact with third-party services such as Google's OAuth and Gmail API for optional email sharing. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of any third-party service.

Our website may contain links to third-party websites or resources. We do not endorse and are not responsible for the content, products, or services offered by third parties.

9. Disclaimer of Warranties

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Extension will meet your requirements, operate without interruption, be error-free, or be compatible with any particular hardware, software, or network configuration. We do not warrant that any defects will be corrected or that the Extension is free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FASTCAPTURE, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE EXTENSION.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the greatest extent permitted by law. In no event shall our total cumulative liability exceed one hundred US dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless FastCapture and its developers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Extension; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the Extension at any time, with or without cause, and with or without notice. Upon termination, your license to use the Extension is immediately revoked.

You may terminate this agreement at any time by uninstalling the Extension. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to the competent courts of France.

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by updating the revision date at the top of this page. For significant changes, we may also provide additional notice (such as a notification within the Extension or on our website).

Your continued use of the Extension after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must uninstall the Extension and discontinue use.
